Consumer Service Terms Payment and Withdrawal
Last updated 10 September 2026
1 Provider and scope of these terms
These terms apply to fixed-price cardiovascular evidence review services purchased by consumers from adiphea GmbH, Zieglersgrübe 47, 97956 Werbach, Germany, represented by Dr. Lutz E. Kraushaar; email lutz.kraushaar@adiphea.com; telephone +49 151 6722 5287; commercial register Amtsgericht Mannheim HRB 729404; VAT ID DE194469299.
A consumer is a natural person acting mainly for purposes outside their trade, business or profession. These services are offered only to adults. Individual written arrangements in the order confirmation take priority over these standard terms. "Working day" means Mondays thru Fridays with the exclusion of public holidays in Germany.
2 What the service is and is not
The service is an independent, asynchronous interpretation of information supplied by the client against epidemiological, biostatistical and published evidence. Its purpose is to organize relevant information, explain risk and uncertainty and help the client prepare for better-informed shared decision-making with their physician.
The service does not establish a doctor–patient relationship and does not provide diagnosis, medical advice, prescribing, treatment instructions, emergency assessment or medical decision-making. It does not replace examination, testing or care by a licensed clinician. Do not use the service for urgent symptoms or an emergency. Contact local emergency services or an appropriate clinician instead.
3 The three service levels
| Service | Included scope | Main exclusions |
|---|---|---|
| Level 1 Cardiovascular Lab Audit €69 | One qualifying cardiovascular laboratory report from one collection date; standardized interpretation; approximately 1–2 pages. | Imaging, historical reconstruction, multiple panels, bespoke literature review, treatment-benefit modelling, consultation and open-ended follow-up. |
| Level 2 Cardiovascular Risk Snapshot €149 | Up to three recent qualifying laboratory reports; relevant trend and discordance review; standardized risk calculations where inputs permit; concise written report. | Raw imaging, long historical reconstruction, broad imaging synthesis, conflicting physician recommendations, bespoke treatment-scenario modelling, consultation and open-ended follow-up. |
| Level 3 Cardiovascular Decision Review €399 | Up to ten relevant documents and approximately 60 submitted pages; qualifying labs, written imaging reports and relevant history; one defined prevention question; substantial written report. | Raw imaging or DICOM files, ECG or other waveform interpretation, unlimited document review, diagnosis, treatment instructions, consultation unless separately agreed, and unlimited follow-up. |
The public form explains which inputs move a request to a higher level. You may choose a narrower level by reducing the material and question to that level’s limits. If the material does not fit the selected scope, we will ask you to narrow it or agree to an upgrade before analysis begins. We do not silently upgrade or charge you more.
4 Application eligibility and offer process
You complete the initial Tally form and select the depth you want. This is a request for a scope and eligibility check, not a purchase and not a free analysis.
We check whether the proposed records are readable, relevant and within one of the defined service levels. We may decline a request that is outside scope or unsuitable.
If the request is accepted, we send a service-specific Stripe payment link. The link identifies the selected service and price.
You place the order by completing Stripe checkout. The contract is formed when the successful payment is confirmed. You receive the contract information and confirmation electronically.
After payment, you are directed to the intake form for the purchased level. Work begins only after the required materials, explicit health-data consent and, where applicable, the request for early performance have been received.
A listing or description on the website is not a binding promise to accept every case. We may refuse an application before payment, for example because the question is outside the service boundary, the records are unsuitable, capacity is unavailable or the request would require medical diagnosis or treatment advice.
5 Client responsibilities and accepted files
You must provide accurate information to the best of your knowledge and submit only material relevant to the agreed question. Remove national identification numbers, insurance numbers, full home addresses and unrelated third-party data. Do not submit raw imaging, DICOM files, ECG waveforms, device exports or other material that the selected service does not accept. You must have the right to provide every submitted document.
The page and document caps are part of the price. If the submission exceeds them, we may ask you to identify the in-scope pages, reduce the submission, purchase a higher level or cancel before work begins. A document is counted according to the uploaded file; pages include appendices and embedded reports.
6 Price taxes and payment
The binding total price is displayed in the Stripe checkout before you pay. Prices are stated in euros and are consumer prices inclusive of any VAT shown as included or otherwise applied in the checkout. No additional service fee will be added after payment without your express agreement. Your bank, card issuer or payment provider may apply its own currency-conversion or transaction charges.
Stripe processes the payment and may offer payment methods based on location and eligibility. adiphea GmbH remains the provider of the evidence review; Stripe is the payment-service provider and is not the seller of the service. A successful payment does not authorize Stripe to receive health records. Do not enter health information in the checkout.
7 Performance and delivery
The estimated delivery period is stated in the payment offer or order confirmation. It starts when we have received payment, the complete usable intake, the required consents and any clarification needed to define the question. If a submission is incomplete or unreadable, the period pauses until the missing information is supplied.
The deliverable is a PDF report in English. Unless otherwise agreed, we provide it through a time-limited Tresorit download link sent to the email address used for the order or intake. Save your own copy before the link expires. Delivery is complete when the report is made available at the agreed electronic address or secure link.
The service includes one request, submitted within seven calendar days after delivery, to correct an objective factual or transcription error in the report. It does not include a new question, additional documents, a new analysis, treatment advice or unlimited correspondence.
8 AI assistance and professional responsibility
We may use the OpenAI API on a pseudonymized working copy to assist with extraction, comparison, consistency checks and drafting. AI output may contain errors. Dr. Lutz E. Kraushaar reviews and finalizes the report; the report is not issued automatically. Further details appear in the Privacy Notice.
9 Your right of withdrawal
If you are a consumer, you generally have the statutory right to withdraw from this distance contract within 14 days without giving a reason. The withdrawal period is 14 days from the day the contract is concluded.
To exercise the right, inform adiphea GmbH, Dr. Lutz E. Kraushaar, Zieglersgrübe 47, 97956 Werbach, Germany, email lutz.kraushaar@adiphea.com, telephone +49 151 6722 5287, of your decision by a clear statement, for example by email. You may use the model form in Section 11, but it is not mandatory. Sending the statement before the period expires is sufficient.
If you withdraw, we will reimburse payments received from you without undue delay and no later than 14 days after we receive the withdrawal notice. We will use the same payment method unless expressly agreed otherwise; you will not be charged a reimbursement fee.
If you expressly ask us to begin work during the 14-day withdrawal period and then withdraw before the service is complete, you may have to pay a proportionate amount for the work performed up to the time of withdrawal, as permitted by law. Your right of withdrawal expires when the service has been fully performed only if, before performance began, you expressly agreed that work could start before the withdrawal period ended and acknowledged that the right would expire upon complete performance.
If you do not request early performance, we will wait until the 14-day withdrawal period has ended before beginning the analysis. Payment alone is not treated as a request for early performance.
10 Cancellation refunds and inability to perform
These statutory withdrawal rights are not replaced by a blanket “no refunds” rule. Before work begins, you may also ask us to cancel; any refund beyond statutory rights will be confirmed in writing. After work has begun, cancellation and any payment for work already performed are assessed under the withdrawal rules, the agreed scope and mandatory law.
If we determine after payment but before substantive analysis that the service cannot be performed with the submitted material, we will offer a reasonable opportunity to correct the intake, agree a different scope, or refund the unperformed service. If we cancel for a reason not caused by your breach and no report is delivered, we refund the amount paid for the cancelled service.
11 Model withdrawal form
Complete and return this form only if you wish to withdraw from the contract:
To adiphea GmbH, Dr. Lutz E. Kraushaar, Zieglersgrübe 47, 97956 Werbach, Germany; email: lutz.kraushaar@adiphea.com
I hereby give notice that I withdraw from my contract for the following service:
Service: ______________________________________________
Ordered on: ___________________________________________
Name of consumer: _____________________________________
Address of consumer: ___________________________________
Date: _________________________________________________
Signature of consumer, only if this form is sent on paper: __________________________
12 Intellectual property and permitted use
You may use the report for your own personal information and share it with your treating clinicians and professional advisers. Unless mandatory law provides otherwise, you may not sell, publish, license, systematically reproduce or use the report or our templates to provide services to third parties without written permission. You retain rights in the records you submit.
13 Liability
Nothing in these terms excludes or limits liability where exclusion or limitation is prohibited, including liability for intent, gross negligence, injury to life, body or health, fraud, a guarantee expressly given, or mandatory product-liability rules.
For slight negligence, adiphea GmbH is liable only for breach of an essential contractual obligation whose performance is necessary for the contract and on which the consumer may ordinarily rely. In that case, liability is limited to the foreseeable damage typical for this contract. These limitations also apply to the company’s legal representatives and agents.
The client remains responsible for medical decisions and for seeking appropriate professional care. This allocation of responsibility does not limit liability that cannot lawfully be limited.
14 Data protection
Personal and health data are processed as described in the Privacy Notice available on the website and linked in the forms and checkout. The Privacy Notice is informational and is not incorporated to reduce statutory rights. Explicit health-data consent is collected separately.
15 Consumer dispute resolution
adiphea GmbH is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board. This does not restrict your right to contact us directly or pursue a legal remedy. The former European Commission online-dispute-resolution platform was discontinued in July 2025 and should not be linked on the website.
16 Governing law and final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, this choice does not deprive you of mandatory consumer protections that apply in that country. No exclusive local court is imposed on consumers; statutory jurisdiction rules apply.
If one provision is invalid, the remaining provisions remain effective to the extent permitted by law. The invalid provision is replaced only through the rules of applicable law, not by an interpretation that reduces mandatory consumer rights.
