Terms of Service & Clinical Disclaimer

1. NATURE OF SERVICE (NON-MEDICAL)

The “Vascular Signal Audit” and “N-of-1 Protocol” provided by Dr. Lutz E. Kraushaar (“The Provider”) are strictly data analytics and health coaching services.

  • Not Medical Advice: The Provider is not a licensed physician or medical facility. The insights derived from Pulse Wave Velocity (PWV) telemetry and Vascular Age (VA) calculations are for educational and informational purposes only.
  • No Diagnosis: We do not diagnose, treat, cure, or prevent any disease. The "Vascular Asset Inventory" (Anamnesis) is used solely to determine eligibility for the data protocol, not to provide a medical prognosis.

2. PARTICIPANT RESPONSIBILITY & SAFETY

By participating in the VSI Audit, you (“The Client”) acknowledge and agree:

  • Physician Consultation: You agree to consult with your primary care physician before initiating any lifestyle interventions (dietary changes, exercise protocols, or supplementation) suggested during the Audit.
  • Immediate Cessation: If you experience any adverse symptoms (dizziness, chest pain, distress) during the protocol, you agree to stop immediately and seek emergency medical care.
  • Contraindications: You confirm that you have disclosed all known medical conditions in the Intake Form. The Provider reserves the right to terminate the service if undisclosed high-risk conditions are discovered.

3. HARDWARE & THIRD-PARTY LIABILITY

The VSI Audit relies on third-party hardware to generate the signal.

  • Device Procurement: The Client is responsible for procuring the Withings Body Comp or Body Scan scale.
  • No Affiliation: The Provider is not affiliated with Withings. We do not warranty the hardware. Any hardware defects, connectivity issues, or shipping delays are the sole responsibility of the manufacturer and the retailer.
  • Data Accuracy: While we use the Withings device for its ballistocardiography capabilities, The Provider is not liable for data errors caused by hardware malfunction or improper user technique.

4. FINANCIAL TERMS & REFUNDS

  • Fee Structure: The Audit Fee ($1,500) covers the intellectual property, data analysis, and consulting time. It is not a fee for a guaranteed physiological outcome.
  • Refund Policy: Due to the digital and high-touch nature of the service:

    • Pre-Summit: A full refund is available if requested before the Day 7 "Go-Live" Summit.

    • Post-Summit: Once the "Go-Live" Summit has occurred, the fee is non-refundable.

5. DATA PRIVACY (GDPR & SECURITY)

  • Data Handling: Your pseudonymized medical data is processed within the PILOT ecosystem in strict accordance with the General Data Protection Regulation (GDPR).
  • No Sale of Data: We will never sell, trade, or rent your personal health information to third parties or insurance providers.

6. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Baden-Württemberg, Germany.
